One of the biggest challenges facing the Trump administration—and the American people—is what Steve Bannon calls a “judicial insurrection,” better known to many as “lawfare.” While the DOJ is no longer under Biden’s control, the battlefield is still stacked high with activist judges—politicized men and women in black robes—who are carrying out the left’s agenda while law and justice get tossed in the dustbin.
Steve Bannon has been sounding the alarm on this for years, but we’ve now hit a critical point. The left is running out of options, their backs are against the wall, and they’re banking on weaponized judges to legislate Trump and the American people into submission. It may feel hopeless—every move President Trump makes seems to be stalled or blocked by left-wing federal judges. But according to attorney Mike Davis, founder of The Article 3 Project, the tide is finally turning.

Mike is right. President Trump and his team see the problem, and they’re taking action to stop it. He’s using the laws already on the books to hold these judicial insurrectionists accountable.
We recently covered this story after yet another federal judge interfered in the DOJ/USAID funding case. And in a move that stunned many, the US Supreme Court—thanks to Justices Roberts and Barrett—sided with the left and the activist judge.
Under new rules, anyone suing to stop the government’s actions will have to put up a financial bond. If the lawsuit fails, they’ll be on the hook for any costs or damages their legal challenge caused.
This move is meant to hold people accountable for filing weak or politically motivated cases against the federal government.

The Trump administration has issued a new memorandum aimed at combatting those seeking universal injunctions against it to halt its policies.
It is going to demand that per federal rules of civil procedure, those bringing the cases put up injunction bonds.
“it is the policy of the United States to demand that parties seeking injunctions against the Federal Government must cover the costs and damages incurred if the Government is ultimately found to have been wrongfully enjoined or restrained. Federal courts should hold litigants accountable for their misrepresentations and ill-granted injunctions.”

This is a quick fix that can be implemented immediately—and it just might help curb some of the lawfare.
And speaking of lawfare, Elon Musk isn’t holding anything back on this issue. He argues that activist judges aren’t real judges at all—and warns that America is being torn apart by a “judicial coup.”

Not long ago, a statement like that might have sounded like hyperbole. Sadly, these days, it’s just reality for anyone paying even the slightest bit of attention.

Also, Senator Mike Lee is fighting to stop these activist judges from trying to run the country from their benches. We also covered that story as well.
America has more than 200 district court judges, yet somehow, many of them seem to believe their tiny little gavels give them veto power over the presidency.
And the left is exploiting this judicial free-for-all at every turn. Every time President Trump tries to enforce DOGE, immigration laws, protect election integrity or implement America First policies, some random activist judge pops up and blocks it nationwide. This is not how the system was designed to work—and if it isn’t stopped, it could spiral into a full-blown constitutional crisis. And that’s exactly what MAGA influencer Charlie Kirk is warning about:

When people see this activist judge crisis, their first instinct is impeachment. And we get it—on paper it’s a solid plan. In fact, it worked perfectly for El Salvador which faced the same problem we’re dealing with now. President Bukele took action, impeaching left-wing activist judges and just like that, his law-and-order agenda was finally able to take root and deliver real results for his citizens.
President Bukele is absolutely right—that would be a permanent solution, but sadly, it won’t work for us. It sounds great in theory, but in reality, the impeachment process in the US takes way too long—and this crisis is unfolding right now.
We need a quick solution.
That’s where Senator Mike Lee comes in. After seeing Charlie Kirk’s warning on X, he responded and made it perfectly clear that he’s working on a game-changing bill to strip district activist judges of the power to issue nationwide injunctions against the US government.
That’s a permanent fix we can implement quickly to shut down the left’s latest judicial weaponization.

Yes, Senator Lee is pushing legislation, but President Trump’s plan to force these judges to put up a bond offers a faster, more immediate fix for the fight we’re in right now. But make no mistake—we need more—much more if we hope to stop this judicial insurrection.
Thankfully, fighters like Mike Davis, Senator Mike Lee, Elon Musk, and Steve Bannon—along with President Trump himself—see exactly what’s happening and are working tirelessly to dismantle this unconstitutional lawfare before it’s too late.
