Minnesota officials are trying to pull a fast one and rewrite the rules as we speak. As ICE moves in to deport people who are here illegally or have overstayed their welcome, state leaders are now crying about the Tenth Amendment, which they claim gives them “sovereign authority” to tell the federal government to take a hike.

The left is dressing up this “10th Amendment” stunt as concern for the health and well-being of the citizens. But if that were the case, they wouldn’t want hordes of criminals running around the state, and they certainly wouldn’t be inciting violence and egging on their unhinged extremist supporters against ICE agents.
Governor Walz is even encouraging citizens to track and harass federal agents, putting their lives at risk. Renee Good found out the hard way what happens when confrontations with ICE turn physical.

Keep in mind, Walz used the National Guard to keep residents in their homes during the COVID sham. But he’s perfectly okay with criminals running around willy-nilly, scamming and endangering people’s lives.

And that’s where this next move comes in: if enforcing the law is the problem, Walz and his buddies will just kick the feds out… or so they hope.
As a side note, the recent “war” over ICE has become a great distraction for Mr. Walz. Minnesota has been rocked by massive Somali fraud for years, especially involving Medicaid and daycare programs that state officials either failed to oversee or just flat-out ignored. Instead of answering for that mess, leaders are picking a public fight with Team Trump and ICE and reframing lawful immigration enforcement as the “real crisis” in the state.
That brings us to Minnesota’s core claim.
They’re claiming the Constitution gives them the power to override federal immigration enforcement inside their borders.

That sounds like a bold plan… until you remember one inconvenient detail. This argument was already lost in court years ago.
If this whole argument feels familiar, it should. The exact opposite fight played out a decade ago, when a state actually wanted to help enforce federal immigration law and the US government said no. That’s where this infamous photo comes from, showing Jan Brewer, then governor of Arizona, wagging her finger in Obama’s face. The two were locked in a heated dispute over immigration enforcement, and Barry ultimately shut the state down.
This is a good scene to remember. IIRC, the woman was the governor of Arizona. The state wanted to help enforce federal immigration law. President Obama said no, the federal government has the sole authority to enforce–or not enforce–federal immigration law. He won in court.

When Arizona tried to step in, the Obama administration argued that immigration enforcement belonged exclusively to the federal government, even when Washington chose not to act. The courts agreed. That ruling didn’t expire, and it didn’t change just because the politics flipped. Obama’s win set the precedent Minnesota is now running into headfirst, and Tim Walz doesn’t have a legal leg to stand on.

And if that wasn’t enough, Biden also tried to challenge the ruling for his benefit, and it also failed.

States don’t get to dictate federal enforcement priorities, and they don’t get to block them either. The Supreme Court made that clear again in 2023.
Which means Minnesota’s current position isn’t a serious constitutional theory. It’s political theater. Governor Tim Walz and his allies are demanding powers they know states don’t have, hoping outrage will cover the legal reality.
