For years now, Dems have threatened to pack the Supreme Court every time a ruling doesn’t go their way. It’s pretty much their go-to tantrum move. And while it’s wildly unpopular with the American people, it’s never really about following through–yet—for now, it’s about pressure.
A new nationwide survey highlighted in a Wall Street Journal opinion editorial found that most Americans don’t support sweeping changes to the Supreme Court, despite President Biden’s last-minute push for such a measure.
The WSJ cited a Mason-Dixon Polling & Strategy survey that found “support for the separation of powers just as many of the speakers at this week’s Democratic National Convention seek to undermine it.”
President Biden, after abruptly leaving the presidential race a month ago, endorsed legislation that would impose term limits for justices, among other things, that would drastically alter the makeup of the high court. His plan is also of questionable constitutionality.
According to the Journal, the Mason-Dixon poll found that after asking likely voters if they “support or oppose amending the U.S. Constitution to change the structure of the U.S. Supreme Court,” 52% of them oppose the idea, while 41% of likely voters support the idea of amending the constitution to change the court’s structure.
But here’s the thing: the pressure works—not because Dems actually pack the court, but because their threat to do so creates fear and leverage. Just look at Chief Justice John Roberts. He’s supposed to be a conservative, but time and time again, he bends toward the left. Why? Probably a whole host of reasons, but one is likely because he’s terrified of headlines. Roberts is terrified of “undermining the court’s legitimacy.”

Newt said it best recently when he talked about Roberts’ role as Chief Justice—and how badly he’s failed to rein in these wildly out-of-control activist judges.

But the left-wing threats have worked. Roberts is terrified of being the guy the media blames for the next so-called constitutional crisis. The left has spent years building this threatening doomsday narrative—calling the Court “illegitimate,” threatening to expand it, and protesting outside justices’ homes—and Roberts has absorbed every ounce of it.

As a result of all these threats and drama, the Chief Justice isn’t ruling on the Constitution. He’s ruling on optics. And now, it looks like Amy Coney Barrett is starting to do the same.
We’ve been ringing the alarm on Amy Coney Barrett for years. From the start, we argued she wasn’t the right choice for such a critical moment. Sure, she held the line on abortion—but beyond that, she’s been a letdown.

However, by now, Roberts’ betrayals have become pretty much predictable, but many had high hopes for Barrett, given her history as a clerk for Justice Scalia, one of the greatest Supreme Court Justices of our time. In fact, she was once hailed as “Scalia’s heir.”

Sadly, that claim couldn’t be further from the truth.
In what many conservatives are calling an outright slap in the face, Amy Coney Barrett and Chief Justice Roberts dealt a blow to President Trump and the US Constitution. They got political, sided with the progressives, and ruled against Trump in the Trump v. New York case.
Amy turned out to be the “Susan Collins” of the Supreme Court. The Revolver piece goes on:
As we’ve said before, Roberts is practically a liberal masquerading in a black robe. Many believe there’s something hanging over him, which might explain why he’s always handing the left their key victories. But Amy Coney Barrett was supposed to be different—a powerhouse for the conservative movement, a beacon of hope. Meh. Instead, she’s turned out to be another weak-kneed RINO. It’s like having a “Susan Collins” type on the Supreme Court bench.
What’s truly troubling is the conservative response to all this defiance and betrayal: silence.
And many of our right-wing leaders, who are afraid to actually fight, support that indifference. They trot out the same tired lines about “being better than that” or taking the so-called high road. Well, guess what? Being better isn’t winning. It’s not stopping the lawfare. It’s not stopping the DOJ from going after political enemies. It’s not stopping the complete and total erosion of our once-sacred institutions. We’re still playing by loser rules while the left is in full street-fight mode—and they’re winning. Bigly.
That’s why it’s time for Republicans to start playing hardball. Not just defending the status quo—but going on offense. Threaten to pack the court. Threaten to blow up the filibuster. Use every tool they’re willing to use—and then some. Not because we want to do it, but because the threat alone can shift the balance of power. It can put pressure on the so-called conservative justices to actually act like conservatives and restore some backbone to the bench.
Conservative attorney Will Chamberlain recently broke this down, and he’s right: if we want to survive the left’s war on law and order, we have to fight like we mean it.

We’re facing a full-blown lawfare crisis in this country—and it’s time to hit back with every weapon in our arsenal. Right now, the Supreme Court is standing on some of the shakiest ground in its history.
A 2024 poll shows that most Americans believe that the Supreme Court is ruled by political ideology, not actual justice and law and order.
A solid majority of Americans say Supreme Court justices are more likely to be guided by their own ideology rather than serving as neutral arbiters of government authority, a new poll finds, as the high court is poised to rule on major cases involving former President Donald Trump and other divisive issues.
The survey from The Associated Press-NORC Center for Public Affairs Research found that 7 in 10 Americans think the high court’s justices are more influenced by ideology, while only about 3 in 10 U.S. adults think the justices are more likely to provide an independent check on other branches of government by being fair and impartial.
Sadly, these days, the Supreme Court is widely seen as a partisan, political institution.

It’s time we start having the hard conversations—yes, even about stacking the court. The left already has. For years, they’ve bullied, threatened, and manipulated the system to get their way, while too many on the right hide behind the high road and call it some kind of principle. But if we want to survive this lawfare onslaught, we have to prove we’ve still got some fight left in us—and that we know exactly what tools we have at our disposal. Because if we don’t start playing hardball now, we’ll be sitting in the dugout wondering—again—how we struck out again.
