JUST IN: The DC Circuit Court of Appeals has ruled defendants convicted of "petty misdemeanors" cannot be sentenced to both jail *and* supervision — a ruling with implications for many Jan. 6 defendants who pleaded guilty and were sentences to both.
This could have implications for dozens of low-level Jan. 6 defendants who pleaded guilty to a single misdemeanor count but were sentenced to short prison terms and several years of supervision.
The ruling was 2-1, and DOJ could appeal to full bench or SCOTUS.
BREAKING: Prosceutors are seeking 33 years in prison for Proud Boys leaders Enrique Tarrio and Joe Biggs.
Also: 30 years for Zach Rehl and 27 years for Ethan Nordean.
They want 20 years for Dominic Pezzola.
DOJ: "The foot soldiers of the right aimed to keep their leader in power. They failed. They are not heroes; they are criminals." https://t.co/10FBvi02T8documentcloud.org/documents/2391…
Any single one of these sentences, from Tarrio to Pezzola, would be the longest sentence yet handed down so far in Jan. 6 prosecutions. Stewart Rhodes is currently the lengthiest at 18 years. documentcloud.org/documents/2391…
👀 JUST IN: Donald Trump wants a trial on charges he tried to subvert the election in…
April 2026 (!)
Trump also guesstimates it will take him 4-6 weeks to present his defense, same estimate as prosecution, which means we're looking at a very roughly estimated 14-week trial, when you factor in jury selection.
NEW: If Trump gets his way his trial in DC would come *5.5 years* after the events that gave rise to his charges for attempting to subvert the 2020 election.
JUST IN: Jeff CLARK is asking federal and local courts in D.C. to postpone bar discipline proceedings against him while the charges against him are pending in Georgia.
John EASTMAN has already made a similar move to forestall California disbarment proceedings but his case is weaker because he already started testifying in June (proceedings are set to continue next week). politico.com/news/2023/08/1…
UPDATE: John Eastman's disbarment proceedings *will* continue next week, but the judge said she's stilll weighing his concerns about his ability to put on a defense while he (and some of his witnesses) are under criminal threat in Georgia.
NEW: Jack Smith obtained a stunning amount of Trump’s data from Twitter — DMs (yes, there were DMs), location info, draft tweets and more — newly unsealed court docs show. https://t.co/ZPNSswoF3Wpolitico.com/news/2023/08/1…
But that’s just the start. The documents show Twitter mounted an unprecedented effort to impede the search warrant by notifying Trump — prompting an incredulous Judge Beryl Howell to wonder if Elon Musk was trying to “cozy up” to him. https://t.co/mVlasM13bOpolitico.com/news/2023/08/1…
Prosecutors repeatedly described Trump learning about their search warrant for his Twitter data as a serious threat to the investigation and to witnesses. https://t.co/suzboQeuKtpolitico.com/news/2023/08/1…
Trump, on Truth Social, has amplified an attack on Judge Chutkan, the first since Friday’s hearing, when she warned against “inflammatory” attacks on the process.
The attack falsely claims she “admitted” to trying to interfere in the election to hurt him.
What she did say is that Trump doesn’t have carte blanche to attack/intimidate witnesses just because he’s running a campaign.
Trump also amplified this verbatim, funnily enough, from me.
UPDATE: Trump going after Chutkan again (at 1am), quoting from her sentencing of Jan. 6 defendant Christine Priola in which she alludes to fact that Trump “remains free” despite hundreds of supporters who went to the Capitol for him facing consequences for Jan. 6.
