British singer and songwriter Ed Sheeran is currently embroiled in a dramatic courtroom battle over alleged copyright infringement involving his 2014 hit song “Thinking Out Loud” and Marvin Gaye’s legendary hit “Let’s Get It On.” Kathy Griffin Townsend, the daughter of  Gaye’s songwriting partner, Ed Townsend, has accused Sheeran of ripping off Marvin Gaye’s 1973 “Let’s Get It On” in his 2014 hit.

The ongoing court case has taken a toll on Ed Sheeran, to the point where he has publicly stated that he may quit music altogether if he loses.

The New York Post:

Ed Sheeran would be “done” if he’s found liable of ripping off Marvin Gaye’s “Let’s Get it On,” he said Monday — as he returned to the stand and again sang and strummed his guitar for a Manhattan jury.

The British singer-songwriter expressed the toll the copyright infringement case has had on him, as his attorney Ilene Farkas asked what would happen if the trial — which began last week in federal court — doesn’t pan out his way and the plaintiffs win ownership of the chord progression in his song.

“If that happens, I’m done – I’m stopping,” Sheeran, 32, responded.

“I find it really insulting to work my whole life as a singer-songwriter and diminish it.”

The case has grabbed the attention of many, including Elon Musk, and sparked debates about how far someone can go with their creativity before it’s considered copying. Elon spoke for many when he tweeted out, “If this keeps going, making new music will be illegal!”

On the flip side, there are some industry insiders who argue that Mr. Sheeran crossed the line, creatively. Rick Beato, a musician and popular YouTuber, recently conducted an intriguing experiment comparing the two songs. After his analysis, he believes that although the lyrics, melody, and verse may differ, the musical content was definitely borrowed from Marvin Gaye.

You be the judge.

The courtroom has been full of drama, with one particularly memorable moment when Sheeran took the stand with his guitar and sang the song in question for the jury. If the jurors rule against Sheeran, a second trial will be held to determine the damages that will be awarded to the Townsend family.
